Petition to Oust Texas DA Jose Garza Gains Momentum

On April 8, 2024, a significant event unfolded in the legal landscape of Travis County, Texas.

A petition was formally lodged in the esteemed 455th Travis County District Court, advocating for the removal of the incumbent Travis County District Attorney, José Garza.

The filing of this petition marked the commencement of a contentious legal battle that would reverberate throughout the region.

Subsequently, on a crucial afternoon on April 19, Dib Waldrip, a prominent figure serving as the 433rd District Judge in Comal County and also holding the distinguished position of Presiding Judge of the 3rd Administrative Judicial Region, made a pivotal decision.

In an authoritative move, Waldrip granted the petition seeking Garza’s removal from office. This decision sent shockwaves across legal and political circles within Texas.

Governor Greg Abbott of Texas had appointed Waldrip to the prestigious role of Presiding Judge of the 3rd Administrative Judicial Region in 2022. Waldrip had been assigned to preside over this contentious case on April 10.

His subsequent decision to grant the application for issuing a citation mandated Garza to answer and appear before the Travis County District Court on May 16.

Furthermore, Waldrip took another significant step by appointing the Office of the Bell County Attorney along with the Honorable Jim Nichols to represent the interests of the state government in this high-stakes legal battle.

This move underscored the gravity and complexity of the case at hand.

The crux of the petition challenging Garza’s tenure revolved around allegations of “incompetency and official misconduct” linked to his office’s prosecutorial policies regarding individuals and criminal offenses.

The petition specifically highlighted three key issues as evidence supporting these serious accusations against Garza:

Firstly, it alleged that Garza unfairly targeted law enforcement officials by routinely presenting charges against them to grand juries without proper justification or discrimination.

Secondly, it claimed that Garza maintained a controversial “do not call to testify” list comprising law enforcement officials he deemed unsuitable to testify or serve as witnesses for prosecutions.

Lastly, it asserted that Garza exhibited a concerning pattern of refusing to prosecute certain classes or types of criminal offenses as mandated by state laws.

Following these developments, prominent figures from Save Austin Political Action Committee such as Matt Mackowiak & Cleo Petricek issued a resounding statement expressing their support for this legal action aimed at holding Garza accountable for his alleged transgressions.

They emphasized that these allegations were grave and if proven true could potentially lead to Garza’s removal from office—a pivotal moment in ensuring public safety within Austin.

The statement further underscored concerns about elected officials like Jose Garza who have pursued controversial policies such as ending prosecutions for low-level drug offenses and implementing lenient criminal justice measures like restorative justice.

It painted a stark picture where such officials posed a significant threat to public order and safety in cities like Austin.
