Attorney General Bailey has taken legal action against the administration, pointing out its failure to fulfill a critical mandate passed by Congress.
According to Attorney General Bailey, “The Biden Administration has not followed the law to complete the construction of a wall along the southwest border,” highlighting the administration’s refusal to uphold its constitutional responsibilities.
This legal win represents a significant moment in the ongoing effort to strengthen our nation’s border amid urgent challenges.
The legal basis for this action stems from a relevant provision approved by Congress in FY 2020, specifically directing the allocation of $1.4 billion for building barrier systems along the southern border.
However, the Biden Administration openly ignored this directive, expressing opposition to wall construction and clearly stating its intention to stop expanding the wall.
When asked about why the administration failed to implement the mandated barrier, a spokesperson stated that “it is not part of this administration’s policy,” reiterating their refusal to comply.
Additionally, the administration sought to cancel remaining funding for border wall construction, attempting to bypass Congress’s legislative authority.
Despite facing resistance from the administration, Missouri and Texas promptly initiated legal proceedings together.
The Biden Administration tried to dismiss General Bailey’s challenges by arguing that he lacked standing to contest fund non-utilization.
The Fifth Circuit Court of Appeals ruled in favor of the states, affirming their right to bring a compelling legal challenge.
Missouri’s successful legal action against the Biden Administration demonstrates a firm commitment to upholding congressional mandates and ensuring effective enforcement of border security measures.
