Federal Indictment Charges Men Threatening ICE Officer, Wife

The federal grand jury indictment announced charges against two men accused of threatening an ICE deportation officer and his wife, detailing social media posts that allegedly named and targeted the agent, and including statements from federal prosecutors and investigators alongside related enforcement context.

A federal grand jury returned an indictment charging two men with knowingly transmitting threats to injure a U.S. Department of Homeland Security Immigration and Customs Enforcement deportation officer and his wife. Prosecutors say one defendant posted a video that identified the officer and showed photographs of him living and working in the Northern District of Georgia. The public posting is at the center of the federal case and prompted the grand jury action.

Court filings describe the posted video and the words used while images appeared on screen. With those images on the screen, Waszut said: “And he’s an ICE agent. This is him unmasked . . . . So, go ahead and make him famous. And if you see this [expletive] out in public give him the cell block one treatment. You know, catch him when he’s alone.” That passage is quoted verbatim from the complaint as part of the charges.

Investigators also flagged a separate comment under a photo of the officer’s wife, which prosecutors attribute to the second defendant. “Anybody wanna test the sites [sic] on their new A-R? There’s a pretty good target right there!” the comment reads, and it is included in the indictment language. The comment references a semiautomatic rifle and is presented in court papers as an explicit threat toward a family member.

U.S. Attorney Theodore S. Hertzberg framed the conduct as unacceptable and illegal. “Federal agents deserve to perform their duties free of harassment from keyboard warriors and other agitators,” said U.S. Attorney Theodore S. Hertzberg. “Threatening law enforcement officers and their families is not only illegal—it’s disgusting. My office will ensure that anyone who threatens a federal agent in North Georgia, or who hides behind a computer screen to intimidate that agent’s immediate family, is found, arrested, prosecuted, and held accountable.”

FBI leadership emphasized the seriousness of threats and the commitment to prosecute. “Threats of violence against law enforcement officers and their families are not only reprehensible, but also a direct attack on the safety and integrity of our justice system,” said Paul Brown, Special Agent in Charge of FBI Atlanta. “These charges serve as a clear reminder that threats of this nature will not be tolerated and will be prosecuted to the fullest extent of the law.” Those remarks mirror the priority placed on protecting federal officials and their families.

The two defendants face different custody statuses and related charges. Anthony Patrick Noto, 63, of Ronkonkoma, New York, was taken into federal custody and arraigned on the indictment. Frank Andrew Waszut, 41, of Knoxville, Tennessee, is in state custody in Texas, where he faces separate terroristic-threats charges tied to alleged threats against Republican lawmakers. Both men were indicted by a federal grand jury on September 23, 2025.

Members of the public are reminded that indictments contain charges only and that the defendants are presumed innocent. This case is being investigated by the Federal Bureau of Investigation. Assistant U.S. Attorneys Brent Alan Gray and Eric White are prosecuting the case. Federal prosecutors will carry the burden of proof at trial if the matter proceeds.

The announcement arrived amid heightened focus on immigration enforcement under the current administration, which has emphasized removals and border action. More than 2 million illegal immigrants have either been deported or chosen to self-deport within the first 250 days of President Donald Trump’s latest presidency, according to government reporting on enforcement totals. The news cycle also recently included an arrest in October of an individual accused of posting a $10,000 bounty on a federal agent.
