DOJ Sues Virginia Over Assault Weapons Ban Threatening Rights

The Justice Department has filed suit against Virginia after Governor Abigail Spanberger signed a new assault weapons ban, setting the stage for a high-stakes legal battle over gun rights and state policy. Expect courtroom fights that will test how far federal authorities will go to challenge a state law enacted by Democratic leaders.

Abigail Spanberger just signed a Democrat-pushed assault weapons ban for the state, and that move instantly put Virginia back in the national spotlight. Conservatives see this as another example of Democrats using state power to clamp down on firearms ownership, and they warn it will not stand unchallenged.

The legislation targets a range of firearms features and adds new restrictions on what firearms residents can buy and keep. Supporters framed the bill as public safety, while critics counter that it criminalizes common rifles and penalizes law-abiding citizens rather than addressing crime and enforcement failures.

“We’re not going to stand idly by and let this new governor ban America’s rifle in the Commonwealth of Virginia,” said NRA-ILA Executive Director John Commerford.

The law also outlaws magazines capable of holding more than 15 rounds of ammunition, a change that will affect millions of existing owners and the secondary market. That single provision creates immediate logistical and legal headaches, forcing owners to alter or dispose of gear they legally purchased under prior rules.

The ban is scheduled to take effect on July 1, arriving just three days before the nation’s 250th anniversary and making the timing politically charged. Opponents argue the date underscores a broader cultural clash over the Second Amendment and the direction Democratic leaders want to push the country.

Assistant Attorney General for Civil Rights Harmeet Dhillon told the Virginia Democrats the Justice Department will see them in court. The federal challenge signals the Biden administration is willing to deploy national resources to oppose a state-level Republican concern, even as many judges wrestle with how to reconcile state regulation and constitutional protections.

From a Republican viewpoint, this lawsuit is predictable and necessary. Conservatives say the law overreaches, punishes responsible owners, and moves the debate from the legislature into the courts where constitutional limits can check partisan majorities.

Legal experts on both sides will parse which parts of the statute are most vulnerable, and challengers will likely press equal protection and Second Amendment arguments. If history is any guide, those arguments will hinge on how courts assess historical tradition, modern regulatory interests, and the proper balance between state authority and individual rights.

The political fallout already matters. Democrats passed the bill with fanfare, calling it a step toward reducing gun violence, while Republicans framed the move as a political stunt that will cost votes and energize a pro-Second Amendment base. Expect campaign messaging, fundraising appeals, and more litigation as the case progresses.
