Biden Released Mauritanian Who Faked Asylum, Became Jail Officer

Federal officials say a recent policy shift is tightening asylum rules and exposing fraud, and one case from Mauritania has become a clear example of how those changes play out in real life.

The Trump administration announced new steps to crack down on fraudulent asylum claims, and Department of Homeland Security Counsel James Percival laid out the problem bluntly. He said, “For many years, millions of illegal aliens have committed fraud in our immigration system. No place is this more rampant than in immigration court. Protection claims like asylum are intended to cover unique and narrow circumstances, but it is standard practice for immigration attorneys representing illegal aliens to assert that virtually every illegal alien is going to be persecuted or tortured in his or her home country.”

One migrant from Mauritania who claimed persecution on the basis of sexuality is now facing deportation after investigators say his story did not hold up. He reportedly arrived in the United States, moved to Indiana, married a woman, and took a job connected to his wife’s family before authorities raised questions about his asylum claim.

Federal officials on Sunday revealed to Fox News Digital that immigration agents arrested a suspected illegal immigrant who allegedly entered the United States under a “fraudulent” asylum claim before later becoming employed as a taxpayer-funded corrections officer in Portland, Indiana.

The detainee, identified as Selah Dine Habib, a native of Mauritania in northwest Africa, was arrested on May 21 after being released into the U.S. by the Biden administration around 2023, according to the Department of Homeland Security (DHS).

Habib claimed to be homosexual on a pending asylum application, DHS alleged, adding that investigators later discovered he had married a woman after entering the country.

According to local outlet WIBC, which first reported the case, the woman was the daughter of the county sheriff whose office later employed Habib as a correctional officer at the county jail.

Officials say the policy changes give ICE attorneys more room to challenge obvious fraud, and that matters because legal networks have sprung up to coach applicants in how to make asylum claims stick. That kind of coaching, if it happened here, undermines legitimate claims and drains enforcement resources from those truly fleeing persecution.

Beyond enforcement, the case raises questions about accountability for the lawyers and firms that assist bad claims. Any attorneys who helped him file a false claim should also be disciplined or disbarred.

The reporting argues this sort of gaming of the system also reveals how immigration policy intersects with politics and identity, claiming, “The Biden administration never would have granted asylum to a Christian.” That comment reflects a broader critique of selective compassion in asylum decisions.

It is striking to some observers that this story surfaced right as ‘Pride Month’ begins, and critics are already asking whether the media will rush to brand enforcement moves as anti-LGBT. Ironic that this comes as ‘Pride Month’ kicks off.

Which media outlet will accuse the administration of being homophobic first? The pushback on all sides is predictable, but the core issue remains whether the system can distinguish real persecution from manufactured claims.

Another problem officials point to is the route many migrants take: they pass through safe countries where they could seek protection instead of continuing to the U.S. That pattern suggests a choice to reach American asylum procedures rather than pursuing protection earlier, and it complicates the legal justification for many claims.

Critics on the right say this case highlights a larger indifference on the left toward real persecution abroad, arguing that some groups treat asylum as a checkbox to gain entry rather than a protection for the genuinely vulnerable. They point to reports of law firms advising migrants to adopt false narratives about sexuality or belief so they can stay, while no pressure is put on hostile regimes themselves.
