A federal judge has blocked Texas’ law banning drag shows where minors can attend, calling the statute an unconstitutional restriction on speech while setting up a new legal fight that keeps state leaders and social conservatives on edge.
The federal ruling invalidated a Texas statute that made it illegal to host drag performances with children present, concluding the measure ran afoul of the First Amendment. The decision landed amid a years-long dispute over how far government can go when it claims it’s protecting kids from certain performances.
The ruling came from 87-year-old Judge David Hittner, a Ronald Reagan appointee who issued the opinion after Attorney General Ken Paxton pushed the case hard on behalf of the state. Paxton argued the law was meant to shield children from what Texas officials described as “sexually oriented performances,” and the courtroom fight reflected those same concerns.
Hittner acknowledged the emotional heat around these events and observed that, while some acts may be “in some sense erotic,” they do not rise to the level of nudity or explicit sexual content. He rested his conclusion on constitutional grounds and made clear the court would not let the state restrict a broad swath of expressive activity in the name of vague protections.

Governor Greg Abbott signed the bill into law in 2023 and it was quickly challenged by national groups that said the statute violated free speech. Hittner issued a temporary restraining order on the law in August of that year, Paxton appealed, the Fifth Circuit vacated that ruling and sent the dispute back to Hittner, and now the judge has once again ruled against the state.
Paxton announced that he would appeal the ruling shortly after it was handed down, calling it “an affront to Texas values.” That exact phrase is being used to rally state officials and conservative activists who view the case as part of a broader culture fight over what kids should be exposed to in public settings.
The decision is a setback for social conservatives in Texas who pushed for restrictions on drag events where minors might be present. Those backers argued for years that the gatherings were inappropriate for children and that lawmakers had a responsibility to set clear boundaries around performances with adult themes.
