With President Joe Biden officially withdrawing from the 2024 presidential race, Republicans are strategizing to create significant obstacles for the Democratic Party as it navigates the aftermath of this development.
As reported by the Daily Mail, The Heritage Foundation, a conservative group, has been meticulously planning a legal battle aimed at impeding or preventing states from removing Biden from the ballot.
The group’s focus is on three crucial swing states—Wisconsin, Georgia, and Nevada—where it aims to make it exceedingly challenging to exclude Biden from the electoral race.
The Heritage Foundation’s Mike Howell has articulated the rationale behind launching this legal fight to maintain Biden’s presence on the November ballot.
“The process for substitution and withdrawal is very complicated,” Howell said. “We will remain vigilant that appropriate election integrity procedures are followed.”

The Daily Mail summarized the laws in the three states mentioned above:
Wisconsin does not allow withdrawal from the ballot for any reason besides death.
In Nevada, no changes can be made to the ballot after 5 p.m. on the fourth Friday in June of an election year or ‘a nominee dies or is adjudicated insane or mentally incompetent.’
If Biden were to withdraw less than 60 days before the election Georgia his name will remain on the ballot but no votes will be counted.
Some other states have comparable laws, while several states lack specific legislation concerning last-minute changes to presidential ballots.
“Policymakers and the public should be prepared for all externalities that arise from President Biden not running for President in 2024. The process for substitution and withdrawal presents many election integrity issues,” the statement continued.
Many Republicans, including Speaker Mike Johnson (R-LA), pointed out that the Democratic Party has essentially erased the votes of tens of millions of voters by forcing Biden out of the race.,
“The Democrat Party forced the Democrat nominee off the ballot, just over 100 days before the election. Having invalidated the votes of more than 14 million Americans who selected Joe Biden to be the Democrat nominee for president, the self-proclaimed ‘party of democracy’ has proven exactly the opposite,” Johnson wrote on his X account.
Despite receiving numerous endorsements, including one from President Biden, Vice President Kamala Harris will need to undergo formal nomination at the Democratic convention.
It is widely speculated that additional candidates will enter the race before the convention begins, potentially leading to a historic showdown.
