Federal Judge Reinstates Labor Board Member, Rules Trump Lacked Authority to Fire Her

A Washington, D.C. federal judge has delivered a controversial ruling that restricts President Donald Trump’s ability to remove a member from an independent labor agency’s board. The decision, which came after Trump attempted to dismiss National Labor Relations Board (NLRB) member Gwynne Wilcox, is the latest example of judicial overreach hampering a duly elected president’s authority.

The dispute arose after Trump sought to remove Wilcox from the NLRB, a board responsible for handling labor disputes and enforcing federal labor laws. However, Wilcox claimed protection under bureaucratic rules that limit the president’s ability to fire board members except for “neglect of duty or malfeasance in office,” a standard she argued had not been met.

Rather than recognizing the legitimate executive authority of the president, U.S. District Judge Beryl Howell sided with Wilcox, ruling that Trump’s attempt to remove a government official he no longer trusted was unlawful. In her decision, Howell lectured the president on his constitutional role, even going so far as to imply that Trump’s decisive leadership style was reminiscent of a “king” or a “dictator.”

This ruling is just another example of activist judges blocking Trump’s efforts to streamline government and root out entrenched bureaucrats who serve the interests of Washington elites rather than the American people. The decision restricts a president’s ability to hold officials accountable and maintain control over agencies that are supposed to serve the public—not dictate policy outside the reach of elected leaders.

The Justice Department rightfully argued that the president must have the authority to remove officials who no longer align with the administration’s vision. As the head of the executive branch, the president is responsible for ensuring that government officials execute policies effectively. Trump’s legal team emphasized that forcing a president to retain a board member against his will is a direct assault on executive power and democratic accountability.

Yet, Howell’s ruling solidifies the power of unelected bureaucrats over the very officials elected to lead the country, a dangerous precedent that limits the ability of future presidents to govern effectively.

The NLRB has long been seen as a left-wing stronghold, pushing pro-union policies that favor organized labor over job creators and small businesses. Wilcox’s background as a pro-union advocate has made her a key player in advancing Biden-era labor policies that stifle economic growth and burden businesses with unnecessary regulations.

Her history-making appointment as the first black woman to serve on the board has been celebrated by the left, but her role has been less about diversity and more about protecting the interests of powerful unions that prop up Democrat politicians.

This ruling ensures that unelected board members, deeply embedded in the Washington bureaucracy, remain in place regardless of the administration in power. It prevents Trump from draining the swamp and removing figures who are more loyal to special interests than the American people.

This case is just one of many examples where Trump has been hampered by activist courts and an entrenched deep state. From attempts to block his travel ban to rulings against his border security policies, left-leaning judges have repeatedly tried to undermine Trump’s America First agenda.

The mainstream media and Democrat establishment will celebrate this decision as a “victory for democracy,” but in reality, it is a blatant attack on presidential authority. No president—especially one as bold as Trump—should be forced to keep bureaucrats who actively oppose his policies.

Trump’s supporters see this ruling as a dangerous expansion of judicial overreach, further cementing a two-tiered system where unelected officials and biased judges can block a president’s ability to govern.

Conservative media outlets such as Fox News and The New York Post have highlighted the case as yet another instance of the deep state shielding its own while weakening the executive branch.

Despite this setback, Trump remains committed to restoring executive authority and ensuring that future presidents are not held hostage by unelected bureaucrats. The fight for presidential power and the battle to drain the swamp is far from over.

As the 2024 election looms, this case serves as a reminder of why Trump must return to the White House—to dismantle the deep state, remove entrenched bureaucrats, and restore power to the American people.
