Archbishop Mitty Athletic Trainer Arrested on Sexual Assault Charges Involving Student

A 31-year-old athletic trainer who worked at Archbishop Mitty High School in San Jose has been arrested on charges that he sexually assaulted a 16-year-old female student he was treating for a sports injury and recorded the alleged assault on his phone, San Jose police said.

Kelvin Chiu was taken into custody after the student reported the alleged abuse to police. Officers responded to the 5000 block of Mitty Way, near the private Catholic school’s campus, at about 7:30 p.m. on Oct. 8.

The student told officers Chiu had been treating her for a sports injury when the alleged assault occurred and that he filmed it on his phone.

Detectives with the Internet Crimes Against Children Task Force obtained warrants for Chiu, his home and his vehicles. On Oct. 9, investigators located him at his residence in Fremont and searched the property. He was arrested and booked into Santa Clara County Jail.

He faces charges of annoying or molesting a minor, production and possession of child sexual abuse material, and sexual battery. Police said a search of his phone turned up child sexual abuse material, and investigators are now examining whether other victims may exist, though none have been identified so far.

Archbishop Mitty is a private Catholic high school with roughly $34,000 annual tuition, known for its academics and sports programs. Police records identified Chiu’s workplace through the school’s address, though authorities have not formally named the school in the investigation.

The Catholic Diocese of San Jose confirmed through spokesperson Cynthia Shaw that Chiu worked at Archbishop Mitty and that the student’s family notified school officials the night of the alleged incident. Chiu has been placed on administrative leave, and the school says it is cooperating with law enforcement.

“Our first concern is for the student and family, and for all of our students and families. We recognize the impact a situation of this nature may have on our students, and the school’s Counseling teams will be available to speak with students who may need additional support,” Shaw told CBS News Bay Area.

School officials said counseling resources will be made available to students as the case proceeds.
