Florida Man Sentenced To 7 Years, 7 Months For Fake PPE Empire

A Florida resident was sentenced to seven years and seven months in federal prison after admitting to a long-running fraud tied to a fake medical supply business that bilked investors and misused millions meant for COVID-19 protective gear.

A federal court handed down a sentence of seven years and seven months to James Elliott Davis, II, 37, of Ponte Vedra Beach following his guilty plea on charges that included bank fraud, wire fraud, money laundering, and theft of mail. The sentence was imposed by U.S. District Judge Jordan Pratt and follows an investigation that uncovered a pattern of deliberate deception stretching over several years.

The court ordered forfeiture of the proceeds from the crimes, which cumulatively totaled $6,726,800, and directed Davis to pay restitution to the victims of his offenses. U.S. Attorney Gregory W. Kehoe announced the outcome and emphasized the financial penalties that will accompany the prison term.

Federal filings say that from March 2018 through 2022 Davis operated a business called Medisale Inc. Prosecutors say he solicited large investments by falsely claiming the company was selling high volumes of COVID-19 personal protective equipment and generating substantial profits.

Davis allegedly told investors he had relationships with hospital executives and contracts to supply N95 masks and other PPE, and he provided fabricated bank statements showing inflated balances as proof. Those false documents and representations persuaded victims to hand over significant sums of money to Medisale.

Investigators found that Medisale had no real hospital contracts and reported no legitimate revenue from PPE sales, contrary to Davis’s claims. He reportedly kited checks and executed fraudulent ACH and wire transfers across multiple financial institutions to create the illusion of healthy account balances.

Prosecutors say Davis used investor funds to pay off prior obligations, to send supposed returns to earlier investors, and to cover personal expenses rather than to buy or ship protective equipment. That cycle of taking new money to mask past shortfalls is a classic hallmark of investor fraud in the records.

“Exploiting the fears of individuals and businesses for profit during a national crisis is untenable,” said U.S. Attorney Gregory W. Kehoe. “Today’s court judgment sends a clear message that this type of fraudulent behavior will not be tolerated.”

“During the COVID-19 pandemic, a time when communities needed real protection, Davis chose deception,” said Ron Loecker, Special Agent in Charge, IRS Criminal Investigation, Florida Field Office. “Schemes that prey on public emergencies are among the most serious frauds we investigate. IRS-CI and our partners will continue to pursue those who exploit emergencies for profit and hold them fully accountable.”

The investigation involved multiple agencies, including the Federal Deposit Insurance Corporation — Office of Inspector General, the Florida Department of Law Enforcement, and the Internal Revenue Service Criminal Investigation unit. The case was prosecuted by Assistant United States Attorneys Kevin C. Frein and Michael J. Coolican.

“Today’s sentencing holds Mr. Davis accountable for orchestrating a scheme that obtained millions of dollars by defrauding innocent investors and multiple financial institutions,” said Special Agent in Charge Quenton Sallows of the Federal Deposit Insurance Corporation Office of Inspector General, Miami Region. “The FDIC OIG will continue to work with our law enforcement partners to investigate financial crimes that harm investors and undermine the integrity of our Nation’s financial institutions.”

The asset forfeiture was handled by Assistant United States Attorney Clint Locke, closing the financial enforcement elements of the case. With the prison term, forfeiture, and restitution ordered, the court has imposed a series of penalties designed to strip away the gains from the scheme and to compensate harmed parties where possible.
